Who is the controller of your data?

The administrator of your personal data is the Foundation for the development of entrepreneurship “TWOJ STARTUP” with its Registered office in Warsaw (with its registered office in Warsaw, at ul. Żurawia 6/12 lok. 766, 00-503 Warszawa, address for service: Atlas Tower, Al. Jerozolimskie 123a, 18th floor, 02-017 Warsaw, registered in the Register of Entrepreneurs of the National Court Register kept by the District Court for the capital city of ul. Warsaw in Warsaw, 12th Commercial Division of the National Court Register under KRS number 0000442857, NIP number: 521-364-12-11, REGON number: 146433467, BDO number: 000460502).

2.            Why do we process your data?

A. in connection with the services provided through TPROLAT consisting in the sale consultations, workshops and training.  I.e. in order to conclude or perform a contract, your data will be stored until the performance of the contract

B. for marketing and promotion of products offered by the “TWOJ StartUp” Enterprise Development Foundation with its Registered office in Warsaw, which are our legitimate interest. Your data will be processed until you object.

C. to comply with any legal obligations imposed on us in connection with the cooperation undertaken, this purpose is related to the legal obligations to store certain documents for the time specified in the law, e.g.:

* Act of 29.09.1994 on Accounting (Journal of Laws of 2017 item 1858);

* Act of 29 August 1997 – Tax Ordinance (Journal of laws of 1997 No. 137 item 926);

* The act of 1 March 2018 – on combating money laundering and terrorist financing (Journal of laws 2018 item 723).

D. for the purpose of establishing, pursuing or defending against claims, which is our legitimate interest. The data will be processed until the limitation of claims

E. in the case of consent, your data will be processed within the limits and for the purpose indicated in the consent.  The data will be processed until the consent is withdrawn.

3. What data is processed?

To conclude a contract, we require you to provide the data on the contract / order form (if you do not provide them, we will not conclude the contract/ perform the order). In addition, we may ask for optional data that does not affect the conclusion of the contract (if we do not receive it, we will not be able, for example, to call the contact number).

During the term of the contract, by providing the services, we come into possession of your other data. The appearance of your personal data with us is a consequence of the operation of our services that you use.

4. Who will the data be shared with?

A. public authorities, to the extent that they do not receive data as part of a specific legal proceeding, e.g. in connection with anti-money laundering;

B. entities that process your personal data on behalf of the foundation on the basis of a contract concluded with the foundation for entrusting the processing of personal data (so-called processors). They will be, m.in.: Foundation beneficiaries, IT professionals, archiving companies, hosting companies;

C. external data controllers (the so – called Parallel Administrator to whom the data is shared, e.g. legal advisers and lawyers, entities conducting courier or postal activities, entities acquiring claims-in case you do not pay our invoices on time),

D. entities located outside the EEA, but only where necessary and with an adequate level of protection, in particular by:

a. cooperation with entities in the countries for which the relevant decision of the European Commission has been issued;

B. application of Standard Contractual Clauses issued by the European Commission.

The Administrator always informs about the intention to transfer personal data outside the EEA at the stage of their collection.

5. Is the data profiled?

We inform you that your data will not be subject to profiling, i.e. automated analysis of your data and making predictions about preferences or future behavior (profiling means, for example, in the case of marketing profiling, determining which offer you may be most interested in based on your previous choices).

6.            What are your rights?

A. right of access to personal data processed by US,

B. right to rectification of personal data, including their Correction,

C. The Right to delete personal data from our systems, the so-called “right

to be forgotten” – if, in your opinion, there is no reason for us to process your data, you can request that we delete it,

D. Right to restriction of processing of personal data – you can request that we restrict the processing of personal data only to their storage or to carry out the activities agreed with you, if we have incorrect data about you or process them unreasonably; or you do not want us to delete them because you need them to establish, exercise or defend claims; or at the time of an objection to the processing of data,

E. right to data portability – you have the right to receive your data from us in a structured, commonly used and machine-readable format (e.g. the “data portability” format).csv”) personal data relating to the country in which we are based on a contract or consent.  This right will be granted if we have data in electronic format – if we have data only in paper form, you will not be able to use this right. You can order us to send this data directly to another entity,

F. Right to withdraw consent to the processing of personal data-at any time you have the right to withdraw consent to the processing of personal data that we process on the basis of. The withdrawal of consent will not affect the lawfulness of the processing that was carried out on the basis of consent before its withdrawal. G. right to object – you may object to the processing of your data if the basis for the use of the data is our legitimate interest. In such a situation, we will no longer process the personal data you have objected to on this basis, unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms.

H. If, in your opinion, the processing of personal data violates the provisions of the regulation, you have the right to lodge a complaint with the Supervisory Authority, i.e. the president of the Office for Personal Data Protection
